Bug Bazaar is committed to protecting our customer's privacy. Please take the time to review this notice which explains what information we collect about you, how we use it and your rights.

WHAT PERSONAL DATA DO WE COLLECT ABOUT YOU?

We collect personal data from you when you provide it to us directly and through your use of the site. This information may include:

  • Information you provide to us when you use our site (e.g. your name, contact details, gender, product reviews, and any information which you add to your account profile);
  • Transaction and billing information, if you make any purchases from us or using our site (e.g. credit/debit card details and delivery information);
  • Records of your interactions with us (e.g. if you contact our customer service team, interact with us on social media);
  • Information you provide us when you enter a competition or participate in a survey;
  • Information is collected automatically, using cookies and other tracking technologies (e.g. which pages you viewed and whether you clicked on a link in one of our email updates). We may also collect information about the device you use to access our site; and
  • Other information necessary to provide the site, for example, we may access your location if you give us your consent.

If you also shop in one of our stores or buy directly from us, we may combine information you give us in-store or in a direct sales situation (e.g. if you make a purchase or join our mailing list in-store) with the information above.

WHAT DO WE USE THIS PERSONAL DATA FOR?

Depending on how you use our site, your interactions with us, and the permissions you give us, the purposes for which we use your personal data include:

  • To fulfill your order and maintain your online account.
  • To manage and respond to any queries or complaints to our customer service team.
  • To personalize the site to you and show you content we think you will be most interested in, based on your account information, your purchase history, and your browsing activity.
  • To improve and maintain the site, and monitor its usage.
  • For market research, e.g. we may contact you for feedback about our products.
  • To send you marketing messages and show you targeted advertising, where we have your consent or are otherwise permitted to do so.
  • For security purposes, to investigate fraud and where necessary to protect ourselves and third parties.
  • To comply with our legal and regulatory obligations.

We rely on the following legal basis, under data protection law, to process your personal data:

  • Because the processing is necessary to perform a contract with you or take steps prior to entering into a contract with you (e.g. where you have made a purchase with us, we use your personal data to process the payment and fulfill your order).
  • Because we have obtained your consent (e.g. where you contact us with a query, where you add optional information to your account profile, or if you consent to receive marketing from us).
  • Because it is in our legitimate interests as an e-commerce provider to maintain and promote our services. We are always seeking to understand more about our customers in order to offer the best products and customer experience. We use information about you to tailor your view of the site, to make it more interesting and relevant in respect of the products and offers on view.

Our site may allow you the option of adding additional information to your account profile. We treat this information with particular sensitivity, as we understand it can reveal information about your health or ethnicity, for example. You do not have to provide this information to us and can delete it or update it at any time.

KLARNA PAYMENTS

In order to offer you Klarna’s payment methods, we might in the checkout pass your personal data in the form of contact and order details to Klarna, in order for Klarna to assess whether you qualify for their payment methods and to tailor those payment methods for you. Your personal data transferred is processed in line with Klarna’s own privacy notice.

MARKETING

We love to communicate with our customers and so, depending on your marketing preferences, we may use your personal data to send you marketing messages by email, phone, or post. Some of these messages may be tailored to you, based on your previous browsing or purchase activity, and other information we hold about you.

If you no longer want to receive marketing communications from us (or would like to opt back in!), you can change your preferences at any time by contacting us (details below), clicking on the ‘unsubscribe’ link in any email, or updating your settings in your account. If you unsubscribe from marketing, please note we may still contact you with service messages from time to time (e.g. order and delivery confirmations, and information about your legal rights).

You may also see ads for our site on third-party websites, including on social media. These ads may be tailored to you using cookies (which track your web activity, so enable us to serve ads to customers who have visited our site). When you see an ad on social media, this may be because we have engaged the social network to show ads to our customers, or users who match the demographic profile of our customers. In some cases, this may involve sharing your email address with the social network. If you no longer want to see tailored ads you can change your cookie and privacy settings on your browser and these third-party websites.

WHO DO WE SHARE THIS PERSONAL DATA WITH?

We share customers’ personal data with third parties in the following circumstances:

  • With other companies in our group of companies, as necessary to operate the site.
  • With our suppliers and service providers working for us, e.g. payment processors and delivery companies.
  • With our professional and legal advisors.
  • With third parties engaged in fraud prevention and detection.
  • With law enforcement or other governmental authorities, e.g. to report a fraud or in response to a lawful request.
  • In the event that we sell any business assets, the personal data of our customers may be disclosed to a potential buyer. In this event, we will make reasonable attempts to ensure the buyer will be bound by the terms of this Privacy Policy.
  • Otherwise where we have your consent or are otherwise legally permitted to do so.

STORAGE AND RETENTION

We use service providers based around the world. Consequently, your personal data may be processed in countries outside of Europe, including in countries where you may have fewer legal rights in respect of your data than you do under local law. If we transfer personal data outside the European Economic Area we will, as required by applicable law, ensure that your privacy rights are adequately protected by appropriate safeguards, in particular, the EU’s standard contractual clauses. Please contact us if you would like more information about these safeguards.

We will keep your personal data for as long as we need it for the purposes set out above, and so this period will vary depending on your interactions with us. For example, where you have made a purchase with us, we will keep a record of your purchase for the period necessary for invoicing, tax, and warranty purposes. We may also keep a record of correspondence with you (for example if you have made a complaint about a product) for as long as is necessary to protect us from a legal claim. Where we no longer have a need to keep your information, we will delete it. Please note that where you unsubscribe from our marketing communications, we will keep a record of your email address to ensure we do not send you marketing emails in the future.

SECURITY

Whilst we do everything within our power to ensure that personal data is protected at all times from our site, we cannot guarantee the security and integrity of the information that has been transmitted to our site.

CHILDREN

Our site is not intended for, and should not be used by, children under the age of 18. We do not knowingly collect personal data from children under 18.

YOUR RIGHTS

You have certain rights in respect of your personal data, including the right to access, portability, correct, and request the erasure of your personal data.

You also have the right to object to your personal data being used for certain purposes, including sending you marketing. See ‘Marketing’ above, for more details of how to opt-out of marketing.

We will comply with any requests to exercise your rights in accordance with applicable law. Please be aware, however, that there are a number of limitations to these rights, and there may be circumstances where we are not able to comply with your request. These Terms and Conditions are valid from 25th July 2022.

Bug Bazaar Online Shop

Prices include the Finnish VAT. We withhold the right to change prices and shipping costs.

VAT in international orders to EU countries that do not allow selling insects as food

As insects in some EU countries cannot be legally sold as food, we sell our food insects to those countries as non-food with non-food VAT. In case you order our insect products to an EU country that does not allow selling insects as food, you should inform Bug Bazaar about that condition in the “Additional information” box of the order submission form. Based on that information, we will adjust the VAT accordingly and a higher non-food VAT will be charged. In case the customer does not accept the additional charge, the order will be canceled and the money the customer has already paid to us will be refunded to the customer.

The VAT on food in Finland is 14% and the VAT on non-food products is 24%.

Ordering

The products are ordered in the online shop by moving them into the basket and by paying the contents of the basket in the online payment service. Confidentiality applies to all customer data.

The information provided by a customer is used for fulfilling the order or for settling possible disputes. If information is used elsewhere, the customer is notified about that and the customer’s permission is asked.

Before placing an order in our online shop, you are expected to have read and accepted the terms and conditions which are valid at a given time.

Klarna Payments

Through Klarna Payments, the payment options are invoice, installment, card payment, and online banking. By providing information at the checkout, you accept the terms and conditions of Klarna AB (https://www.klarna.com).

PayPal

You can pay by PayPal. The instruction for registering and using the service can be found here

PayTrail

Paytrail Plc acts as a collecting payment service provider and is an authorized Payment Institution. Paytrail Plc will be shown as the recipient on your bank or credit card statement. Paytrail Plc will forward the payment to the merchant. For reclamations, please contact the website the payment was made to.

You can order an invoice by email.

Order and payment confirmations

After receiving your order, we will immediately send you an order confirmation with all the information we have received from you.

  • Please check the order confirmation.
  • In case you have any questions, please contact our customer service.
  • Save the order confirmation to have your customer number and order information available if you need to contact our customer service.
  • When you have received the order, please check that it has the same contents as the order confirmation you have received from us.

The method of shipment and shipping costs

The ordering cost includes shipping and packaging costs. When you place an order, our shop card will show you an estimate of the cost for the shipping method you have selected. The shipping costs depend on the weight of the products you purchase.

The exact shipping cost is shown to you before you pay your order.

A NOTE FOR HEAVY PURCHASES
Shipping costs for international orders are high and we want to offer the best possible service to our customers. In case your order weighs one kilogram or more, you should directly contact our customer service. In that way, we can manually tailor your order and plan the best shipping method for your needs!

A NOTE FOR LETTER-SIZED FLAT PURCHASES
If you only order 1-3 flat and light products, they can probably be shipped as a letter, which is a lot cheaper shipping method than the parcels listed as available shipping methods. In case you think your order would fit into an envelope, please register as a customer and send us an email so that we can put your order together manually.

Delivery Time

Our goal is to despatch an order within 30 days from receiving the payment. The duration of the transportation after sending the order and the delivery time depends on the shipping method customer has chosen.

In case you have ordered a product that has run out of our stock, we will inform you immediately when we notice the stock out.

Customers will be informed about potential delays in delivery times on the front page of our online shop.

Force Majeure

Notwithstanding anything to the contrary contained herein, the Rights Agent shall not be liable for any delays or failures in performance resulting from acts beyond its reasonable control including, without limitation, acts of God, terrorist acts, shortage of supply, breakdowns or malfunctions, interruptions or malfunction of computer facilities, or loss of data due to power failures or mechanical difficulties with information storage or retrieval systems, labor difficulties, war, or civil unrest.

Product Returns

You can cancel your order from Bug Bazaar within 14 days of placing your order without any special reason. The 14-day cancellation period is calculated from the receipt of the ordered goods. If you are a consumer and open a food product you have purchased from Bug Bazaar, you will not lose the right to cancel your order, but you will be liable for any reduction in the value of the goods. Because the resale value of an opened food product is zero, you virtually lose the opportunity to get your money back when you open our product, unless there is a noticeable defect in the product we purchase.

If you wish to cancel your order, please notify Bug Bazaar Customer Service immediately by writing. We will register the arrival of your message as the moment of the cancellation of your order. We can then agree on one of the best ways to return the goods you have ordered to the Bug Bazaar and return the payment or part of the payment to you.

Any refund will be made using the payment method you used when you placed your order in the Bug Bazaar.

The customer who wishes to cancel the transaction for no particular reason due to the Bug Bazaar is responsible for the cost of returning the products back to the Bug Bazaar. The customer is obliged to ensure that the products are adequately packaged to protect them from damage during transport. Upon receipt of the return shipment, Bug Bazaar will inspect the products and reimburse customers for the price of the products that arrived undamaged.

Upon receipt of the delivery, the customer must immediately check that the delivery has included the products he has ordered and that the products are externally free of defects. Products do not need to be opened to inspect the contents.

If the customer discovers a defect in the product after using the product, he must notify Bug Bazaar customer service no later than within 7 days of detecting the defect.

In the event of a delay or error within the meaning of the Finnish Consumer Protection Act found in the delivery or, products, the provisions of Chapter 5 of the Finnish Consumer Protection Act concerning the penalties for delay and error shall apply.

Free Order Cancellation

The customer can cancel their order free of charge if Bug Bazaar receives the customer's cancellation notice before Bug Bazaar has purchased transportation for the order. The time of receipt of the cancellation notice is the moment when someone in our customer service actually receives and responds to the order cancellation notice. We recommend that you submit your cancellation notice in more than one way to ensure that your cancellation notice arrives. Email, cell phone messaging, and calling together are a safer way than using just one notification method.

Unclaimed Shipments

Unclaimed shipment is not the same as a returned shipment. We do not refund money for unclaimed shipments.

Damaged or Disappeared Products

In case the shipment has disappeared or suffered damages during the transportation, you are expected to give Bug Bazaar customer service a notice of defects within 14 days of the arrival of the order. In case the shipment has suffered damage during transportation, you should complain about that to the shipping company.

Intellectual Property/Trademarks

To protect our images, design, content, logos, product descriptions or the overall look and feel of your website, nothing contained within the website should be used by a third party without the prior written consent of the owner of the website.

The Applied Law in Retail Orders to Consumers

In general, the Finnish Law is applied to orders placed at Party Bugs. Potential disputes are solved in Finnish courts. In the event of a delay or error within the meaning of The Finnish Consumer Protection Act found in the delivery of products, the provisions of Chapter 5 of the Finnish Consumer Protection Act concerning the penalties for delay and error shall apply. Controlling Law and Jurisdiction in Business-to-Business Orders

These Terms and any action related thereto will be governed by the laws of Finland. The application of the United Nations Convention on Contracts for the International Sale of Goods, private international laws (e.g. conflict of laws principles), and consumer protection e-commerce regulations, where relevant, are expressly excluded. The exclusive jurisdiction and venue of any action or court proceeding permitted under these Terms will be the competent court of Helsinki, Finland and each of the parties hereto waives any objection to jurisdiction and venue in such courts.
